Update From the NCWM Annual Meeting

 

The National Conference on Weights and Measures (NCWM) held its Annual Meeting in Pittsburgh, Pennsylvania last week. The NCWM Annual Meeting is one of two national meetings held by the Conference and the Annual Meeting is where policy proposals are voted on by conference members for incorporation into one of the NIST Handbooks used by weights and measures regulators to oversee the wholesale and retail petroleum industry.

Three items before the NCWM were of primary importance to PMCI members. The NCWM has been debating a 10-micron filter mandate for retail dispensers offering diesel fuel. That item has officially been withdrawn from the NCWM voting agenda and the filter requirement for diesel dispensers will remain at 30-microns for the foreseeable future. PMAA estimates that by defeating the 10-micron filter mandate marketers stand to save $200 million a year.

An emerging issue within the NCWM is the regulation of water in underground storage tanks (UST) selling motor fuel. Currently, the regulatory tolerance for water in a retail UST is 1 inch. The developing proposal before the NCWM would tighten that regulatory threshold and would allow only ¼ inch of water to be present in a UST. This item was left on the NCWM agenda for future meetings and PMCI anticipates that it will become a very heavily debated topic at future NCWM meetings.

Finally, the NCWM, much like many state and federal agencies, is just now beginning to update their regulations to accommodate the labeling of ethanol and gasoline blends with an ethanol content greater than 10%. One proposal put before the NCWM cited Federal Trade Commission (FTC) labeling requirements for E10+ blends without referring to EPA requirements for E15 which require a specific label. The adoption of this proposal would have subjected retailers to potential fines levied by EPA under its jurisdiction through the Clean Air Act and created consumer confusion amongst the public. The intent of EPA’s E15 labeling requirement is to provide consumers information about the gasoline product through a consistent labeling practice. The incorporation of the two agencies labeling requirements for E10+ blends will remain informational within the conference for the time being.
