Iowa Underground Storage Tank Rule Moving Forward

The Iowa Department of Natural Resources Underground Storage Tank Section (DNR UST Section) will be presenting its final rule to the Iowa Environmental Protection Commission (EPC) in November. The DNR UST Section final rule implements the Environmental Protection Agency’s 2015 revisions to its underground storage tank regulations.
The final rule set to be presented to the EPC in November requires the periodic testing of containment sumps, spill buckets, overfill prevention devices and release detection equipment by October 13, 2021. Containment sumps, spill buckets and overfill prevention devices are required to be tested or inspected every three years thereafter. Release detection equipment must be tested annually.
After the rule is presented to the EPC, the rule will move through Iowa’s formal rulemaking process including the opportunity for public comment. FUELIowa anticipates the rule to be finalized in the April/May timeframe. Once the rule is finalized, owner/operators will be required to begin monthly walkthroughs at their facilities upon implementation.
