EPCRA Tier II Hazardous Chemical Reporting Deadline – March 1

 

The Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA) establishes requirements for Federal, State, local governments, Indian Tribes, and industry regarding emergency planning and "Community Right-to-Know" reporting on hazardous and toxic chemicals. The act requires the establishment of a State Emergency Response Commission (SERC) and Local Emergency Planning Committees (LEPCs). In Iowa the SERC is made up of the Iowa Homeland Security & Emergency Management Department (HSEMD) and the Iowa Department of Natural Resources (DNR).  Environmental Protection Community Right-To-Know Act (EPCRA) Section 311/312 requires facilities that have a material safety data sheet (SDS) for any hazardous chemicals stored or used in the work place above certain quantities to submit an emergency and hazardous chemical inventory form (TIER II) to the SERC, LEPC, and local fire department. The TIER II form encompassing 2019 is due on March 1st, 2020. Approximately 500,000 products have SDS forms.

Facilities storing over 10,000 pounds of hazardous chemicals on-site are subject to the Tier 2 reporting requirements.  FUELIowa bulk plant owner/operators are subject to the Tier 2 reporting requirements.  FUELIowa members that operate retail facilities with 75,000 gallons or less of gasoline storage capacity and 100,000 gallons or less of diesel fuel storage capacity are exempt from EPCRA reporting requirements.  If your retail facility has a storage capacity that exceeds these thresholds, please contact John Maynes in the FUELIowa office.
